Welcome to Coincert. These Terms of Service (“Terms”) govern your use of the Coincert application on iOS and macOS (“the App”), a product of The Artificer of Ciphers, LLC. By downloading, installing, or using Coincert, you agree to these Terms. If you don’t agree, please don’t use the App.

Important: This document is a draft and should be reviewed by a qualified attorney before publication. Legal requirements vary by jurisdiction and may change over time.


1. About Coincert

Coincert is a personal finance management application that helps you track your checking accounts, savings accounts, and credit cards. The App allows you to view balances, organize transactions, and manage your financial information in one place. Coincert connects to your financial data through manual entry, CSV file imports, and Apple FinanceKit.


2. Eligibility

You must be at least 18 years old to use Coincert. By using the App, you confirm that you are at least 18 and that you have the legal capacity to enter into these Terms.


3. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use Coincert on Apple devices that you own or control, for your personal, non-commercial use, subject to these Terms and Apple’s applicable usage rules set forth in the App Store Terms of Service.

You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works based on the App or any part of it.


4. Your Account and Data

You are responsible for maintaining the security of your Apple ID and any devices on which Coincert is installed. You are responsible for all activity that occurs through the App on your devices.

Any financial data you enter, import, or connect through the App is your responsibility. You should verify that your account balances, transactions, and other financial information displayed in Coincert are accurate by checking with your financial institutions directly.


5. Third-Party Services

Apple FinanceKit

Coincert uses Apple FinanceKit to access financial data from your Apple Wallet, including Apple Card. Your use of FinanceKit is subject to Apple’s terms and conditions. Apple controls the authorization and data-sharing process entirely. We are not responsible for the availability, accuracy, or completeness of data provided through FinanceKit.

Apple iCloud

If you enable iCloud sync, your Coincert data is stored in and synced through your personal iCloud account. Your use of iCloud is governed by Apple’s terms of service. We are not responsible for iCloud outages, data loss within iCloud, or changes Apple may make to iCloud services.

By using any of these third-party services through Coincert, you acknowledge that you have reviewed and accepted their respective terms.

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. To the fullest extent permitted by applicable law, we disclaim all warranties, whether express, implied, or statutory, including but not limited to:

8. Limitation of Liability

To the fullest extent permitted by applicable law, Coincert and its developers, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

In no event shall our total liability to you exceed the amount you paid for the App in the twelve (12) months preceding the claim, or fifty US dollars ($50.00), whichever is greater.

You acknowledge that you use Coincert at your own risk and that the limitations above are a fundamental part of these Terms.

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

We are not responsible for the loss, corruption, or destruction of your financial data for any reason, including but not limited to:

You are solely responsible for maintaining backups of any financial data that is important to you. We strongly recommend regularly exporting your data and keeping independent records of your financial information.

All rights, title, and interest in and to the Coincert application — including its design, code, graphics, logos, and content — are owned by The Artificer of Ciphers, LLC and are protected by applicable intellectual property laws. Coincert is a trademark of The Artificer of Ciphers, LLC. These Terms do not grant you any rights to our trademarks, brand features, or other proprietary content.

Your financial data remains yours. We do not claim any ownership of the personal financial information you enter, import, or connect through the App.


12. Indemnification

You agree to indemnify and hold harmless Coincert and its developers, officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.


13. Termination

You may stop using Coincert at any time by deleting the App from your devices. We may also terminate or suspend your access to the App at any time, for any reason, without notice.

Upon termination, your license to use the App ends immediately. Sections 7 through 12 of these Terms (Disclaimer of Warranties, Limitation of Liability, Data Loss, Acceptable Use, Intellectual Property, and Indemnification) shall survive termination.


14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means before the changes take effect. Your continued use of Coincert after changes become effective constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically.


15. Apple-Specific Terms

These Terms are between you and Coincert, not with Apple. Apple is not responsible for the App or its content. However, as required by the App Store Terms of Service:


16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in the State of North Carolina.


17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.


18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Coincert regarding your use of the App. They supersede any prior agreements or understandings, whether written or oral.
